HAY QUARTER SESSIONS.
———✦———

A sitting of the Court of Quarter Sessions was opened yesterday. His Honor Judge Forbes presiding. Mr Harris prosecuted on behalf of the Crown, the Bar being otherwise represented by Mr Moriarty.
…

UNNATURAL OFFENCE

William Walker, a boy, and Ah Ying [aka Ah Yeen, Ah Yen], were charged with attempting to commit an abominable offence at Kilfera.

William John Walden stated that both the accused were employed as general station hands at Kilfera. He gave evidence as to seeing the two accused in certain circumstances, and threatening to report the matter to the “boss,” which he subsequently did. The details of the evidence cannot be published.

Evidence was given as to the report being made to the manager of the station, and also as to the arrest of the prisoners. The effect of this evidence was that Walker had made various admissions in a more or less defiant spirit, whilst the Chinaman, after denying his guilt for some time, ultimately endeavoured to persuade the witness Walden no to report him.

Both the accused gave evidence on their own behalf, each blaming the other.

The jury brought in a verdict of guilty.

The police reported that the accused Walker had previously been convicted in Sydney of horse-stealing, and released under the provisions of the First Offenders’ Probation Act .

Each accused was sentenced to 18 months’ imprisonment, Walker in Goulburn, and Ah Ying in Darlinghurst gaol.

HAY QUARTER SESSIONS.
———

Thit [sic] court opened on Monday before His Honor Judge Forbes. Mr Harris prosecuted for the Crown. Mr Moriarty was the only barrister present. The solicitors present were—Messrs H Norton, L Robertson and SP Kemp. Mr JS Lavender represented the sheriff.
…

UNNATURAL OFFENCE.

William Walker oud [and–sic] Ah Yen were charged with committing an unatural [sic] offence on the 17th of February at Kilfera station.

The prisoners pleaded not guilty and were undefended.

William J Walden groom at Kilfera stated that the two accused were general station hands; Walker is about 16 or 17; I remonstrated with Walker, and told him he could get seven years for the crime he committed and he said he did not care, and would cut his throat first, like his brother did. Walker said he was a jockey.

The Chinaman and Walker denied the statement made by the witness, the latter saying he had not a brother.

RC Webb gave evidence of the offence having been reported to him, and he ordered both parties off the station.

Constable Capewell deposed to having arrested Walker, and the Chinaman.

The two prisoners went in the box, and each accused the other of committing the offence.

His Honor summed up, and the jury retired, and after an absence of an hour and a half, returned with a verdict of guilty against both accused.

Sub-Inspector Johnson said Walker was convicted in Sydney for horse stealing on 19th of October last, which was suspended, under the First Offenders Act.

His Honor said Walker would now have to undergo the sentence of 18 months passed on him for horse stealing. His Honor then sentenced the prisoners to 18 months Walker in Goulburn, and Ah Yen in Darlinghurst gaol.
