…

A NEW TRIAL.

Walter Toovey appealed from his conviction before Judge Scholes at the Sydney Quarter Sessions on a charge of assault. He was sentenced to three years’ imprisonment, and he based his appeal on the grounds that the conviction was against the evidence, that he was not guilty, and that he had other evidence to call. Mr ER Abigail appeared for the accused, and Mr CA White for the Crown. The Court set the conviction aside, and ordered a new trial.

…

CONVICTION QUASHED.
REX v WALTER TOOVEY.

Mr ER Abigail appeared for the prisoner in support of the appeal, and Mr CA White for the Crown. The prisoner was convicted in July last before Judge Scholes and a jury at Quarter Sessions of assault, and was sentenced to three years’ penal servitude. He now appealed on the grounds that the conviction was against evidence, that he was not guilty, and that a portion of his Honor’s summing up to the jury was erroneous, and calculated to prejudice the prisoner.

The Court said the conviction must be quashed, and a new trial ordered, so that certain difficulties in the case might be cleared up one way or the other.
