UNIQUE INCIDENT
———◦———
Juryman Gives Evidence
————
Wanton Driving
A unique feature of the hearing at the Darlinghurst Sessions of a charge of wanton driving was the appearance of one of the jurymen in the witness box.
John Alexander Heatley, 32, a salesman, was charged with wanton driving, causing bodily harm to a woman passenger in another car with which Heatley’s car had collided.
One of the jurymen drew attention to the omission on booth sides to mention that it had been raining on the day of the accident. The juryman went into the witness-box and gave evidence to that effect. He identified the date by another accident at Rosebery.
After he was told that, owing to the civil claim, Heatley had sold up his home and paid out everything, Judge Armstrong bound him over. The judge said that he was satisfied that Heatley was a good type of driver, and bore an excellent character.
The judge declared that he was glad to see that jurors were taking more notice of reckless and careless motor driver in the streets.

WANTON DRIVING
JUROR GIVES EVIDENCE.
The hearing was concluded of the charge against John Alexander Heatley, 32, salesman, of causing bodily harm to Ethel O’Donnell, at Mascot, on May 5, by the wanton driving of a motor car, which struck the rear of the car in which Mrs O’Donnell was a passenger.
Mr Sproule (of Messrs RD Meagher, Sproule, and Co) appeared for the accused.
At the conclusion of the case, a juror remarked that nothing had been said as to the state of the weather at the time, and intimated that he remembered rain having fallen upon that particular day on which a stand had collapsed at Rosebery Park, when a number of people had been injured. The juror was sworn, and gave evidence to that effect.
After viewing the locality in which the accident occurred, and after questioning witnesses, the jury returned a verdict of guilty. His Honor remarked that he was glad to notice that juries were beginning to take furious and wanton driving more seriously than in the past. He sentenced the prisoner to seven months’ imprisonment, with hard labour, in Goulburn Gaol, but suspended the sentence under the First Offenders’ Act upon the prisoner entering into recognizances of himself and one surety in £20 each to be of good behaviour for 12 months.

GAOL FOR SEX OFFENDERS
———◦———
“You picked an innocent boy. I do not intend to pass it over lightly.”
Thus Judge Curlewis at the Sydney Quarter Sessions last to William Pinkerton, who had been found guilty of an offence against an eleven-years-old boy at the Sydney Showground on the night of January 16. His Honor passed sentence of two years’ gaol with hard labor.
A second case in which John Alexander Heatley was found guilty of what Judge Curlewis termed a “filthy and loathsome offence” occupied the attention of a jury the following day.
Heatley, an unemployed commercial traveller, claimed that at the time of the commission of the alleged offence he was so far under the influence of intoxicating liquor that he did not appreciate the nature of his acts.
Detective Wells told the judge after conviction that Heatley was a married man with two children.
Sentence of twenty-three months gaol was passed.
Mr GM Stafford appeared for Heatley.
