QUARTER SESSIONS.

(Before Judge Murray.)
…
APPEALS.
…
David Withers, a carpenter, appealed against a conviction by Mr Payten, SM, on September 7 last, on a charge of indecent behaviour in Victoria park, on the ground that the conviction was against the weight of evidence. The appeal was dismissed and the conviction sustained, with £5 5s costs. On account of the appellant’s previous good character, however, the sentence of three months imposed by the magistrate was suspended conditional upon Withers entering into the necessary recognisances to be of good behaviour for 12 months. Dr Cullen appeared for the appellant, and Mr H Harris for the respondent.
